Arranging an OxCHEPS mediation


The OxCHEPS Mediation Service will maintain the confidentiality of the material submitted via completion of this Form, subject to copying it as necessary to one or more of its mediators and on the assumption that each and every party to a dispute approaching OxCHEPS has shared with the other party/parties the information given in jointly completing this Form in order to seek mediation. OxCHEPS undertakes to provide one of its mediators, but is not able to guarantee it can do so; nor is it able to control, still less guarantee, the success of the mediation process if the parties and the OxCHEPS-identified mediator in due course agree to embark upon mediation.

10. The fee for the OxCHEPS Mediation Service in finding a mediator is £100, returnable if OxCHEPS is unable to provide a mediator acceptable to both/all the parties. Please upload this Form to OxCHEPS [Click the Send button below]. The confirmation page which follows will contain the details you provided. Please print that out, sign it and send the hard copy of this Agreement (enclosing a cheque for £100, made payable to ‘New College, Oxford’) to: OxCHEPS, c/o The Bursar, New College, OXFORD, OX1 3BN. (NB: Where the dispute is between a student/employee and a HEI, we would expect the HEI to make the payment for mediation and then to recover up to half the cost from the other party on a basis to be agreed as part of the mediation.) Once OxCHEPS has provided a mediator it is between the parties and the mediator to agree on his/her mediation fee, and for the former to make direct payment to the latter. Such fees are usually based on a daily rate set by each mediator, and reasonable travel/accommodation/subsistence expenses will also be charged: again, it is likely that the mediator will expect to be paid by the HEI, leaving it to share the cost as it agrees with the other party/parties. The OxCHEPS Mediation Service does not need to levy VAT, and nor do most of its mediators unless they are operating as part of a legal firm or as practising barristers.
