The Law Of Higher Education
Online Casebook
COPYRIGHT
1) Most cases are Crown copyright ‘original’ opinions and judgements, and many can be down-loaded for printing from the public websites covering House of Lords opinions (www.publications.parliament.uk/pa/ld199697/ldjudgmt/ldjudgmt.htm) and Court of Appeal/High Court judgements (www.courtservice.gov.uk). Much the same material is available at www.bailii.org – which also provides links to similar sites in many other countries.
2) Cases not available to down-load from the above public sites can usually be found in the Westlaw or Lexis databases as electronic versions of the copyrighted and ‘headnoted’, printed and purchasable case reports (‘All England Law Reports’, ‘Education Law Reports’, etc) at, respectively, www.westlaw.com and www.lexis-nexis.com. These sites can usually be accessed via, or password supplied in, the HEI Library, and individual cases then down-loaded for printing.
3) Where it has not been possible to identify or trace copyright for a few older/obscure printed case reports, they are reproduced with apologies to the copyright holder and with an assurance that due acknowledgement will be given if the copyright holder both identifies itself to OxCHEPS and gives permission for the continued display of the case-report(s), or that the case-report(s) will be removed if such copyright permission is not forthcoming when formally requested by OxCHEPS.
