15 THE ROLE OF JUDICIAL REVIEW IN THE STATUTORY HEIs

A. Introduction

The statutory HEIs, like the chartered HEIs, rely on the Law to interpret the contract between HEI and its students or its staff (whether academics or other employees). In the case of student-HEI disputes, the OIA might be involved (see Section H of Chapter 13 [link]); in the case of employees, the issue will probably be handled by an Employment Tribunal (see Chapter 11 [link]).

There are circumstances, however, when the Law might be invoked by way of judicial review, in order to clarify whether the statutory HEI has fair and proper procedures, whether it is applying them in a reasonable way, whether it might be exceeding its powers (acting ultra vires), etc. Or even to clarify whether any HEI, chartered or statutory, itself is getting fair treatment from, say, a funding body or an accreditation agency.

Judicial review has become something of a growth industry in recent years, but, although more judicial review cases than ever before are being heard, many of them do not get the result the seeker hoped for, and many other seekers of judicial review do not even get past the first hurdle of an initial hearing to decide whether there really is a case to be pursued.

Very few judicial review cases have yet involved higher education disputes. Yet judicial review is a ‘heavy’ and fast-moving legal process that can be used, or threatened, as an aid to concentrating the mind of a HEI as to whether it really does appreciate the legal position and feels secure in defending it.
